This Fair Use Policy explains reasonable usage expectations for NexLabs Studios LLC services and how we may address excessive, abusive, automated, or resource-intensive use.

1. Purpose

NexLabs Studios LLC ("NexLabs," "we," "our," or "us") operates services that may rely on shared computing, storage, networking, API, AI, gaming, database, and infrastructure resources.

This Fair Use Policy is designed to help ensure that one user, account, application, integration, or automated process does not unreasonably degrade the experience, availability, performance, or security of our services for others.

This policy supplements our Terms of Service and Acceptable Use Policy .

2. Reasonable Use

Users are expected to use NexLabs services in a manner consistent with the intended purpose of the applicable product or plan.

Reasonable use generally means usage that:

  • Is consistent with normal product operation.
  • Does not intentionally overload NexLabs systems.
  • Does not materially degrade service for other users.
  • Does not circumvent technical restrictions.
  • Does not create excessive or abusive traffic.
  • Does not consume disproportionate shared resources.
  • Complies with applicable plan limits or quotas.

3. Shared Resources

Some NexLabs services operate on infrastructure shared among multiple users or products.

Shared resources may include:

  • CPU.
  • GPU capacity.
  • Memory.
  • Database connections.
  • Storage.
  • Bandwidth.
  • API capacity.
  • Worker queues.
  • AI inference capacity.
  • Game server resources.
  • Network connections.

NexLabs may manage these resources dynamically to preserve stability and availability.

4. Usage Limits and Quotas

Individual services, accounts, plans, APIs, or products may have stated or technical limits.

Limits may apply to:

  • Requests.
  • API calls.
  • Storage.
  • Bandwidth.
  • Processing time.
  • AI inference.
  • Model usage.
  • Tokens.
  • Concurrent sessions.
  • Upload size.
  • Account creation.
  • Job execution.
  • Game actions.

Published limits may be enforced automatically.

NexLabs may also impose temporary limits when reasonably necessary to protect service availability, security, or other users.

5. Automated Use

Automated tools, scripts, bots, agents, integrations, crawlers, scheduled jobs, and similar systems must use NexLabs services responsibly.

Automated usage should not:

  • Generate unreasonable request volume.
  • Continuously retry failed requests without backoff.
  • Ignore rate-limit responses.
  • Create unnecessary duplicate requests.
  • Maintain excessive concurrent connections.
  • Circumvent quotas.
  • Create unnecessary load on shared infrastructure.

Applications should implement reasonable retry logic, caching, batching, rate control, and error handling where appropriate.

6. API Usage

NexLabs APIs may enforce request limits, authentication requirements, scopes, quotas, or usage restrictions.

Users may not intentionally evade API limits by:

  • Rotating API keys.
  • Creating additional accounts.
  • Distributing requests across identities solely to bypass limits.
  • Manipulating headers or identifiers.
  • Circumventing authentication.

NexLabs may throttle or temporarily block applications that generate excessive traffic.

7. Artificial Intelligence Services

AI services may consume significant computational resources, including GPU capacity, inference time, retrieval resources, model context, and storage.

NexLabs may apply reasonable limits to AI services including:

  • Prompt volume.
  • Concurrent requests.
  • Context length.
  • Output length.
  • Model availability.
  • Retrieval volume.
  • Tool or agent execution.
  • Processing time.
  • GPU usage.

Experimental systems such as ForgeAI may also use dynamic routing, queuing, prioritization, or fallback mechanisms to manage limited compute resources.

Access to a feature does not guarantee unlimited use of every model, tool, agent, or compute resource.

8. Games and Communities

NexLabs games and communities may impose fair-use limits to protect game balance, server stability, and player experience.

Limits may apply to:

  • Automated actions.
  • Repetitive requests.
  • Server connections.
  • Inventory operations.
  • Marketplace activity.
  • In-game transactions.
  • Messaging.
  • Account activity.
  • API or bot integrations.

Attempts to gain an unfair advantage through automation, excessive multi-accounting, exploit abuse, or resource manipulation may also violate the Acceptable Use Policy .

9. Infrastructure and Compute Resources

NexLabs may provide or expose infrastructure-related services involving servers, workers, containers, databases, nodes, queues, or compute resources.

Users may not intentionally consume disproportionate resources in a manner that negatively affects other users or systems.

Examples may include:

  • Unbounded processes.
  • Infinite loops.
  • Uncontrolled job creation.
  • Excessive database queries.
  • Excessive concurrent connections.
  • Unnecessary polling.
  • Resource exhaustion.
  • Excessive logging.

10. Storage and Bandwidth

Services offering storage, uploads, downloads, hosting, file delivery, or bandwidth may impose quotas or usage thresholds.

Users should avoid:

  • Using storage services primarily as an unrestricted public file mirror where not intended.
  • Generating excessive duplicate files.
  • Creating abusive download traffic.
  • Using NexLabs systems as unauthorized CDN capacity.
  • Circumventing storage quotas.

Some products may offer paid overage or expanded usage options.

11. Circumventing Fair-Use Controls

You may not intentionally bypass technical controls designed to enforce fair use.

This includes:

  • Creating multiple accounts to bypass limits.
  • Rotating credentials to avoid throttling.
  • Manipulating requests to avoid usage measurement.
  • Distributing traffic across accounts solely to evade restrictions.
  • Attempting to disable or interfere with metering.
  • Attempting to alter recorded usage.

12. Enforcement

Where NexLabs identifies excessive or unreasonable use, we may take measures reasonably necessary to protect the service.

These measures may include:

  • Throttling.
  • Rate limiting.
  • Queue prioritization.
  • Temporary restrictions.
  • Reduced concurrency.
  • API key restrictions.
  • Temporary suspension.
  • Requesting migration to an appropriate service plan.
  • Termination in cases of repeated or intentional abuse.

Where practical, NexLabs may attempt to provide notice before materially restricting legitimate high-volume usage.

Immediate restrictions may be imposed where usage poses a security, stability, abuse, or operational risk.

13. High-Volume and Business Use

Users with unusually high or predictable workloads are encouraged to contact NexLabs.

We may be able to provide:

  • Higher limits.
  • Dedicated infrastructure.
  • Increased API quotas.
  • Custom deployment.
  • Enterprise capacity.
  • Dedicated AI resources.
  • Custom storage or bandwidth arrangements.
  • Custom service agreements.

High-volume usage is not automatically prohibited. The purpose of this policy is to ensure that resource consumption matches the service and capacity provided.

14. Changes to This Policy

NexLabs may update this Fair Use Policy as products, plans, infrastructure, usage patterns, or technical requirements change.

The "Last Updated" date at the top of this page will identify the current version.
