DMCA & Copyright Policy
NexLabs Studios LLC respects intellectual property rights. This policy explains how copyright owners may submit notices regarding allegedly infringing material associated with NexLabs-operated services.
1. Overview
NexLabs Studios LLC ("NexLabs," "we," "our," or "us") respects the intellectual property rights of creators, developers, businesses, publishers, and other rights holders.
We may remove or restrict access to material where we receive a valid copyright infringement notice or where we otherwise determine that material violates applicable law or our policies.
This policy is intended to describe procedures consistent with the Digital Millennium Copyright Act, where applicable.
This policy may apply to NexLabs websites, games, platforms, communities, hosted content, applications, APIs, user-generated content, and other services.
2. Copyright Takedown Notices
If you believe that material available through a NexLabs-operated service infringes your copyright, you may submit a written notice requesting that the material be removed or disabled.
Your notice should clearly identify the allegedly infringing material and provide enough information for NexLabs to locate and evaluate it.
Copyright complaints are legal notices. You should not submit a DMCA notice unless you have a good-faith belief that the identified use is unauthorized.
3. Required Information for a DMCA Notice
A copyright infringement notice should include:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.
- Identification of the copyrighted work claimed to have been infringed.
- If multiple copyrighted works are involved, a representative list may be provided where appropriate.
- Identification of the material claimed to be infringing or the subject of infringing activity.
- Information reasonably sufficient to permit NexLabs to locate the material.
- Your name.
- Your mailing address.
- Your telephone number, where appropriate.
- Your email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate.
- A statement, made under penalty of perjury where required, that you are the copyright owner or are authorized to act on behalf of the owner.
Providing screenshots, URLs, usernames, file names, content identifiers, or other specific location information may help us process the notice.
4. Counter-Notices
If material you submitted was removed or disabled because of a copyright complaint and you believe the removal occurred because of mistake or misidentification, you may be able to submit a counter-notice.
A counter-notice should generally include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled.
- The location where the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name.
- Your address.
- Your telephone number, where appropriate.
- Your email address.
- Any legally required statement consenting to the jurisdiction of an appropriate federal district court.
- A statement that you will accept service of process from the person who submitted the original notice or that person's agent, where legally required.
NexLabs may forward a valid counter-notice to the original complaining party.
5. Restoration of Material
Where applicable law permits, material removed pursuant to a copyright notice may be restored after receipt of a valid counter-notice unless the original complaining party informs NexLabs that legal action has been filed seeking to restrain the allegedly infringing activity.
NexLabs may decline to restore content where the material independently violates our Terms of Service, Acceptable Use Policy, community rules, or applicable law.
6. Repeat Infringers
NexLabs may suspend or terminate accounts of users who repeatedly infringe intellectual property rights where appropriate and legally required.
Relevant factors may include:
- The number of valid complaints received.
- The nature of the alleged infringements.
- The user's history.
- Whether prior warnings were issued.
- Whether content was repeatedly re-uploaded after removal.
NexLabs may also restrict features, disable uploads, or take other reasonable measures.
7. False or Misleading Notices
You should not knowingly submit false, fraudulent, misleading, or materially inaccurate copyright notices or counter-notices.
Misrepresenting that material is infringing may result in legal liability.
NexLabs may refuse to process notices that appear fraudulent, incomplete, abusive, or unrelated to copyright.
8. Third-Party Platforms and Content
Some NexLabs services may integrate with platforms or infrastructure controlled by third parties.
These may include:
- Discord.
- FiveM.
- External hosting providers.
- Social media platforms.
- Blockchain networks.
- Third-party APIs.
- External file storage providers.
If allegedly infringing material is controlled entirely by a third-party service, NexLabs may be unable to remove the underlying material.
In those cases, you may need to submit a complaint directly to the third-party platform.
9. Public, Distributed, and Immutable Systems
Some NexLabs products may display or index information from public blockchains, distributed ledgers, public networks, or other third-party data sources.
NexLabs may not control the underlying network or original data.
Certain information may be:
- Publicly replicated.
- Stored by third-party nodes.
- Distributed globally.
- Technically immutable.
- Outside NexLabs' ability to delete.
Removal of content from a NexLabs interface does not necessarily remove the underlying information from a public blockchain, distributed network, external host, or third-party system.
10. Trademark and Other Intellectual Property Complaints
The DMCA primarily addresses copyright infringement.
Trademark, trade dress, impersonation, domain-name, or other intellectual property complaints may be reviewed separately.
A non-copyright complaint should clearly identify:
- The rights claimed.
- The allegedly infringing material.
- The basis of the complaint.
- Your relationship to the rights holder.
- Relevant registration information, where applicable.
11. Record Preservation
NexLabs may preserve records relating to copyright complaints, removed content, counter-notices, enforcement decisions, account identifiers, and associated communications.
Records may be retained where reasonably necessary for:
- Legal compliance.
- Dispute resolution.
- Repeat-infringer enforcement.
- Fraud prevention.
- Security.
- Defense of legal claims.
